Introduction
These Terms, Conditions, and Return Policies (“Terms”) apply to all sales and services, whether made:
- In person
- By phone
- By email
- Through our website or online store
By purchasing from Crescent Bearing & Supply, Inc. (“Crescent”), the customer acknowledges and agrees to all Terms stated here. Crescent may update these Terms at any time; the version in effect at the date of sale or order placement will apply.
1. Product Information & Availability
Crescent aims to provide accurate product descriptions, measurements, and pricing. However:
- Product availability may change without notice
- Specifications may vary by manufacturer
- Typographical errors or outdated listings may occur
If an ordered item is unavailable, Crescent will contact the customer with alternatives, lead times, or refund options (for non–special-order items).
2. Pricing & Payment Terms
Unless stated otherwise in writing:
- Standard terms: NET 30 for approved credit accounts
- All other orders require payment at time of purchase
- Prices do not include taxes or shipping unless specified
- Prices are subject to change without notice
Past-due accounts (over 30 days):
- May incur interest charges
- May incur late fees
- May be placed on hold until the balance is paid in full
Crescent may require deposits or full prepayment for special orders.
3. Sales Tax
Sales tax will be charged where applicable unless a valid exemption certificate is provided beforehand.
Accepted exemption types include:
- Resale
- Farm use
- Manufacturing
- Government / nonprofit exempt organizations
4. Shipping, Delivery & Pickup
Most orders ship or are ready within 1–2 business days unless otherwise noted. Delivery times are estimates and not guaranteed.
Crescent is not liable for:
- Carrier delays
- Weather events
- Supply chain disruptions
- Delivery damage caused by carriers
In-store pickup is available during normal business hours at our Salem, IL location.
5. Returns & Refund Policy
Crescent maintains strict return guidelines due to the nature of industrial parts, safety considerations, and contamination risks.
5.1 No Returns on Installed or Used Parts
Any item that has been:
- Installed
- Pressed into place
- Mounted
- Used in equipment
- Contaminated by grease, oil, dust, or debris
is not returnable under any circumstances.
This applies to (including but not limited to):
- Bearings
- Seals
- Oil bath seals
- Hydraulic components
- Bushings
- Electrical or electronic parts
5.2 Special Orders & Customer-Specified Items (Non-Returnable)
A special order is any item that is:
- Not normally stocked by Crescent
- Ordered specifically at the customer’s request
- Sourced using customer-supplied part numbers, measurements, photos, samples, or descriptions
All special orders:
- Require full payment unless otherwise agreed in writing
- Cannot be canceled once the order is placed
- Are non-returnable and non-refundable
- Must be paid in full upon arrival
Customer-Supplied Information:
If the customer provides incorrect part numbers, measurements, thread sizes, photos, samples, or equipment descriptions and the item is incorrect as a result, the customer remains fully responsible for the purchase.
5.3 Hydraulic Hose Assemblies (MTO – Non-Returnable)
All hoses and assemblies that are:
- Custom cut
- Custom crimped
- Built to specification
- Made to order
are non-returnable and non-refundable, whether used or unused. This is industry-standard due to safety and liability requirements.
5.4 Returnable Stock Items (If Unused)
Only regular in-stock merchandise may be returnable, and only with prior approval, provided the item is:
- New
- Unused
- In original packaging
- In resaleable condition
Restocking Fees:
- No restocking fee for standard stocked items returned in perfect condition
- Special-order items may incur vendor-based restocking fees if a return is approved (rare)
Refunds are issued after inspection and only to the original payment method.
6. Warranty Policy
All products are sold subject to the manufacturer’s warranty only. Crescent does not offer independent warranties beyond the manufacturer’s terms.
The following are not covered by manufacturers or Crescent:
- Misalignment
- Improper installation
- Incorrect lubrication
- Contamination
- Overloading
- Incorrect part selection
- Damage caused by associated machinery
- Failures due to misuse or neglect
Crescent may assist with warranty submissions when applicable but does not guarantee approval.
7. Limitation of Liability
To the fullest extent permitted by law, Crescent is not liable for:
- Machine or equipment damage
- Downtime
- Labor costs
- Loss of production or revenue
- Consequential or incidental damages
- Freight charges
- Removal or reinstallation costs
- Improper use or application of products
Crescent’s total liability shall never exceed the purchase price of the product sold.
8. Customer Responsibility & Disclaimer of Reliance
While Crescent may assist in identifying parts or suggesting options, final responsibility rests solely with the customer.
The customer is responsible for:
- Verifying fitment
- Providing accurate measurements
- Providing correct part numbers
- Specifying thread sizes, models, and configurations
- Ensuring correct application and installation
The customer acknowledges that they are not relying on Crescent’s advice or representations, but on their own judgment, measurements, or professional installer. Crescent is not responsible for incorrect selections, misidentification, or misapplication based on customer-supplied information.
9. Integration Clause
These Terms constitute the entire agreement between Crescent and the customer regarding the sale of products and services.
No verbal statements, recommendations, or promises made by Crescent employees or representatives shall modify or override these Terms unless expressly stated in a written document signed by an authorized Crescent representative.
10. Order Cancellations
Orders may be canceled only if:
- The order has not yet shipped
- The item is not a special order
- The item is not already in fabrication (e.g., hose assemblies)
Once shipped, specially ordered, or placed into fabrication, orders cannot be canceled.
11. Claims & Shortages
All order issues must be reported within 48 hours of:
- Pickup
- Delivery
- Receiving shipment
After this period, Crescent bears no responsibility for shortages, damage, or discrepancies.
12. Attorney Fees & Cost Recovery
If Crescent prevails in any legal action, collection effort, or dispute arising out of a transaction, Crescent is entitled to recover:
- Attorney fees
- Court costs
- Collection fees
- Any other reasonable expenses incurred in enforcing these Terms
13. Force Majeure
Crescent is not liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to:
- Natural disasters
- Acts of God
- Supply chain disruption
- Vendor shortages
- Transportation failures
- Labor disputes
- Government actions
14. Governing Law
These Terms are governed by the laws of the State of Illinois. Any disputes shall be resolved exclusively in the courts of Marion County, Illinois.
15. Acceptance of Terms
By purchasing, accepting, installing, or using products from Crescent Bearing & Supply, the customer confirms that they have read, understand, and agree to be bound by these Terms, Conditions & Return Policies.
